Pracovněprávní aktuality - březen 2017

Článek přináší přehled aktualit z pracovněprávní oblasti za období od 7. 3. 2017 do 3. 4. 2017. V tomto přehledu se mj. zaměříme na návrh zákona, kterým se mění zákon o sociálních službách, konkrétně novela řeší pomoc úplně bezmocným lidem či rodinám, kterým se současně narodily dvě a více dětí. Navrhovanou úpravou zákona vzniká také tzv. ošetřovatelský domov jako nově zavedená sociální služba, která má vyřešit situaci osob, které potřebují současně zdravotní i sociální péči.

Employment Law Update – October 2012

The article provides an overview of prepared and adopted changes in employment law in the period from September 4, 2012 to October 2, 2012. It further informs about the amendment to the Act on Specific Health Care Services aimed to remove the most controversial provision of the present legal regulation. The EU is represented by a report about planned increase of the number of women in the Supervisory Boards of big companies.

The English part deals with the limits for employment of disabled persons.

Employment Law Update – September 2012

The article provides an overview of prepared and adopted changes in employment law in the period from August 4, 2012 to September 3, 2012. It further informs about the announcement of the Labour Office concerning its functioning during the first half of the year 2012 or the information given by the Czech Social Security Administration about the transfer of documentation about employment related injuries and diseases from the employers to the CSSA.

The English part deals with an interesting judgement of the Czech Supreme Court which considers surfing websites unrelated to employee´s work as grounds for dismissal.

Employment Law Update – August 2012

The article provides an overview of prepared and adopted changes in employment law in the period from July 3, 2012 to August 3, 2012. It further informs about a new amendment to the Act on Complementary Pension Savings or the summary of the Ministry of Labour and Social Affairs concerning the fight against illegal employment of foreigners in 2011.

Employment Law Update – July 2012

The article provides an overview of prepared and adopted changes in employment law in the period from June 1, 2012 to July 2, 2012. It further informs, for instance, about the recent decision of the Constitutional Court which declared constitutionality of the regulation of so called guard period, or the European Commission Programme for social change and innovation.

The English part deals with a judgment of the European Court of Justice regarding the employer’s rejection of an unsuccessful job applicant and its explanation.

It further analyses the issue of storage of employment law documents at the workplace and relating guidelines of the State Labour Inspection Office along with official statement of the Office for Personal Data Protection.

The article provides an overview of prepared and adopted changes in employment law in the period from April 2, 2012 to May 2, 2012. It further informs about the project of Ministry of Industry and Trade concerning the fast track procedure for in-house redeployment of workers of foreign investors.

Employment Law Update – April 2012

The article provides an overview of prepared and adopted changes in employment law in the period from March 2, 2012 to April 2, 2012. It further informs about new guidelines of the Ministry of Labour and Social Affairs on employing third-country foreigners in the Czech Republic. The guidelines provide a number of new restrictions in order to decrease the level of unemployment among Czech citizens.

The English part deals with the same issue as mentioned above.

Employment Law Update - March 2012

The article provides an overview of prepared and adopted changes in employment law in the period from February 3, to March 1, 2012. It informs about the legislative intent of Law on strike which aim is to regulate the right to strike in collective disputes between employees and employers and also about preparation of a new amendment to the directive on the introduction of measures to encourage improvements in the safety and health at work of pregnant workers and workers who have recently given birth or are breastfeeding, where are, however, deep discrepancies between the European parliament and the Council especially about the minimum length of maternity leave.

The English part deals with the changes in sickness insurance in 2012.

Employment Law Update - February 2012

The article provides an overview of prepared and adopted changes in employment law in the period from January 3, to February 2, 2012. It informs about the regulations commented in past issues and presents the most important prepared regulations. In the first part the article informs about the new competency of the State Labour Inspection Office in the area of illegal employment and also about the new EU directive on a single application procedure for a single permit for third-country nationals to reside and work in the territory of a Member State and on a common set of rights for third-country workers legally residing in a Member State.

The English part deals with the legislative intention for new acts on entry and residence of foreigners.
